Packages containing ecstasy intercepted in Illinois

A 31-year-old Illinois man has been charged with drug possession, attempted drug possession and manufacturing, trafficking and delivering a controlled substance after ecstasy worth about $80,000 was allegedly discovered in packages mailed to him. He is being held at the Kane County Jail, and his bail has been set at $80,000 according to media reports. The man was taken into custody following a two-week investigation conducted by the Department of Homeland Security, the Geneva Police Department, the Kane County Sheriff’s Office and the U.S. Postal Service.

The investigation was launched when the DHS intercepted two packages that had been sent from the Netherlands to addresses in Geneva. DHS agents determined that the packages contained about 175 grams of ecstasy. One of the packages was mailed to the man’s Fargo Boulevard residence. Law enforcement decided to allow the package to be delivered, and then agents, officers and deputies executed a search warrant when it arrived.

The search allegedly led to the discovery of an undisclosed quantity of cocaine, approximately 65 grams of marijuana and 7 grams of psychedelic mushrooms in addition to the ecstasy. Law enforcement allowed the second package to be delivered when they learned that the man controlled the Kingston Drive address on the shipping label. Other packages mailed to the man were intercepted during the investigation. In total, approximately 683 grams of ecstasy were seized.

Experienced criminal defense attorneys may seek to have seized narcotics excluded and drug charges dismissed when police failed to obtain a search warrant or obtained a warrant based on dubious probable cause. When law enforcement appears to have acted correctly and rights protected by the Fourth Amendment do not seem to have been violated, attorneys might choose instead to pursue a negotiated plea agreement. The penalties for narcotics trafficking can be severe, but prosecutors are sometimes willing to reduce them substantially in return for a swift and successful resolution.
